General Commission Terms and Conditions

By commissioning Asurii and paying the subsequent invoice, the client agrees to all terms and conditions. These terms are available to read in all commission forms posted, which are the only avenue of commissioning, and are therefore accessible to all commissioners. Failure to read these terms and conditions does not exempt clients from them as it is the clients responsibility to read and understand these terms and conditions.

Hereafter all licensed materials purchased via commissioning me will be referred to as the “commission” or “commissioned works”.

When commissioning, please provide any relevant social media so that posted commissions can be attributed to the proper person.

If the illustration the client wants me to create is sexual by nature, he/she must be 18 years or older to purchase such services.

I reserve the right to decline any commission request for any reason. I am not required to state this reason.

I will not draw anything regarding gore, scat, pedophilia, rape, watersports, zoophilia, or any uniforms that I may deem tasteless.

If the character already exists and is owned by someone else other than the client without my knowing, I am not responsible for possible consequences and the client agrees to take full liability for any repercussions. This term will also apply to copyrighted characters from entertainment companies, i.e. Disney, Nintendo.

I cannot accommodate specific due dates/ deadlines. Certain special qualifications may apply to this rule.

In the event a client does not respond for a period of three days and the invoice has been paid, work will continue without client input. In the event there is a similar nonresponse before payment, the commission will be dropped.

I retain the right to post the finished art piece to my galleries. Commissions may be kept private for an additional charge.

I will not directly copy or attempt to mimic reference material or other art styles as requested, respectively. In the case of the former, a pose reference may still be provided, but note that I will use it as no more than a reference.

All invoices are for digital illustrations. There is no physical package included.

Turnaround Time

Commissions may take anywhere from one week to 2+ months. I am not the fastest artist, and commission time varies based on the specifics of each commission.

Copyright Terms

Clients are only paying for the creation of a commission, unless discussed further. I reserve the right to use my art for commercial use, portfolio purposes, etc.

Commissions may not be used by the client for commercial purposes unless the rights to each specific piece are purchased. The intent to purchase rights for a commission must be disclosed prior to work on the commission. 

If the client chooses to use the commission for personal purposes, credit where due is appreciated.

Do not claim ownership of my art. You own your character, I own the artwork.

The usage of commissioned works, in part or in whole, may not be used in any way in relation to non-fungible tokens (NFTs). This includes but is not limited to the creation, production, publishing, marketing, sale, etc, of NFTs.

Artworks done by the illustrator may not be used in any way for machine learning, artificial intelligence, or derivative technologies. 

In the event that a third party uses any commissioned works in a way that breaches the terms of this license or any sub-licenses granted to the client, including unauthorized use of commissioned works, the client may be held liable for any consequential loss or damages to the artist.

Should the client choose to change, modify, or adjust the commissioned works through the use of machine learning, ai generative algorithms, or derivative technologies; or to create derivatives of the work through the use of such technologies, then the client understands this is considered an automatic purchase of exclusive rights to the commissioned artwork and the client agrees to pay it in full. Please inquire about the exact fee in advance.

The illustrator is entitled to the receipt of any income generated, directly or indirectly, from use commissioned works in any way that is in breach of the license and may charge an additional fee for breach of license. This fee may as much as double the price of the commissioned work, in addition to the total amount of income generated either directly or indirectly from use of the commissioned work in breach of contract. A reasonable fee for perceived value of the commissioned work or any derivative of it produced by breaching the licensing may also be charged.

Canceling Commissions

Invoices are always sent after a rough sketch has been given a greenlight by the client. After this stage, you may still request cancellation of the commission, however any refunds will take into account the amount of work completed. 

If the illustration is near completion, refunds will no longer be given. The level of completion is subject to my personal opinion as the artist.

Sexually suggestive or explicit content is restricted to commissioners ages 18 and up. If the client is a minor and attempts to commission suggestive or explicit content, I will cancel the commission, and if payment has already been made, it will not be refunded. 

If an extraordinary amount of time (typically over a year) has passed without a finished product, a full refund will be provided upon request regardless of the level of completion. 

In the event of any extreme situation such as injury, natural disaster, or anything else which might leave me unable to complete a commission, full refunds will be provided when possible, upon request.

References and Changes

References for all characters to be included in an illustration are required. Special exceptions may be made for particularly descriptive text references, however this may incur a small extra fee (as it greatly hinders my ability to work in a timely manner).

If references have a markedly different style or anatomy than as exemplified in my works, I will take the liberty of interpreting it to my art style.

No significant changes will be made to the illustration past the rough sketch without a surcharge. The exact charge is subject to my discretion.

This surcharge is subject to how difficult changes will be for me to implement.

Past the sketching phase, minor alterations (such as edits to a pattern or shape, small details, etc) will be made free of charge as long as the amount of work remains within reason.
